What is the GDPR?
The European Commission adopted the General Data Protection Regulation (GDPR) in 2016. It became enforceable beginning May 25, 2018. The GDPR strengthens the requirements for the security and privacy of personal data in the European Union (EU) and harmonizes EU data protection laws by applying a single data protection law that is binding on EU Member States.
What is the UK GDPR?
The UK GDPR is the UK General Data Protection Regulation and largely mirrors the GDPR. It is a UK law which came into effect on 1 January 2021. It sets out the key principles, rights, and obligations for most processing of personal data in the UK, except for law enforcement and intelligence agencies. The UK GDPR sits alongside the Data Protection Act 2018, as amended on 1 January 2021 by regulations under the European Union (Withdrawal) Act 2018, to reflect the UK’s status outside the EU.
How does the GDPR and UK GDPR affect Viewpoint customers?
When it comes to GDPR and UK GDPR compliance, both Viewpoint and our customers have shared responsibilities: our customers as data controllers, and Viewpoint as a data processor. To quote from the GDPR FAQ page, “A controller is the entity that determines the purposes, conditions, and means of the processing of personal data, while the processor is an entity which processes personal data on behalf of the controller.”
We require our customers and their users to comply with all applicable laws and regulations in connection with the use of Viewpoint software. In particular, we expect our customers to have all rights and consents necessary to allow Viewpoint to lawfully process personal data provided by our customers to Viewpoint.
Does Viewpoint transfer data internationally?
The data centers used for primary and backup hosting for Viewpoint’s software products provided to our UK and EU-based customers are located in the UK. In limited circumstances, in the course of providing services to and conducting business with our UK and EU-based customers, certain personal data may be processed outside of the UK or EU.
Does Viewpoint use subprocessors?
Yes, Viewpoint uses a small number of subprocessors to host our cloud-based software products offered to UK and EU-based customers and to deliver certain functionality to customers. View a list of our current subprocessors.
